This disclaimer applies to the Charta: AI Chart Analysis & Trading Assistant app (hereby referred to as the "Application") for mobile devices, created by Altan Koray Benli (hereby referred to as the "Service Provider") as a Freemium service. By downloading, installing, accessing, or using the Application, you (the "User") acknowledge that you have read, understood, and agreed to every provision of this disclaimer. If you do not agree with any part of this disclaimer, you must immediately stop using the Application and uninstall it from your device.

The Application provides automated analyses of trading charts, market visualizations, and related content using artificial intelligence models. All analyses, signals, commentary, summaries, probabilities, price projections, entry/exit suggestions, stop-loss or take-profit levels, sentiment readings, pattern identifications, and any other content generated by or displayed through the Application are provided strictly for informational, educational, and illustrative purposes only.

Nothing generated, displayed, or communicated through the Application constitutes, is intended to constitute, or should be interpreted as: (a) financial advice, (b) investment advice, (c) trading advice, (d) tax advice, (e) legal advice, (f) accounting advice, (g) a recommendation, offer, or solicitation to buy, sell, hold, or transact in any financial instrument, security, commodity, derivative, cryptocurrency, token, contract for difference (CFD), or any other asset, or (h) an endorsement of any trading strategy, asset, broker, exchange, platform, or service.

The Service Provider is not a registered investment adviser, broker-dealer, financial planner, fiduciary, portfolio manager, commodity trading advisor, or any other type of licensed or regulated financial professional. No fiduciary, advisory, agency, or professional relationship is created between the User and the Service Provider by virtue of the User downloading or using the Application.

The Application relies on artificial intelligence models, including large language models and vision models, to interpret user-submitted images of charts. AI-generated output is inherently probabilistic and may contain errors, omissions, hallucinations, fabricated data, outdated information, miscategorizations, incorrect pattern recognition, or misinterpretation of visual content. The Application may misidentify assets, timeframes, indicators, price levels, support/resistance zones, chart patterns, or market context.

The User acknowledges and accepts that: (a) AI output can be wrong, inconsistent, or internally contradictory; (b) identical inputs can produce different outputs; (c) the Application cannot guarantee accuracy, completeness, timeliness, or reliability of any analysis; (d) the Application does not have access to real-time market data, order books, fundamentals, news, or proprietary data sources unless explicitly displayed in the submitted image; and (e) the User must independently verify any information before acting on it.

Trading, investing, and speculating in financial markets—including but not limited to stocks, equities, bonds, futures, options, foreign exchange (forex), commodities, cryptocurrencies, digital assets, tokens, and derivatives—involves a substantial and irreducible risk of loss. Market prices are highly volatile and can move rapidly against a position. It is possible to lose some, all, or more than the amount originally invested. Leverage, margin, and derivative products can amplify losses beyond the initial deposit.

Past performance, historical patterns, backtested results, and prior outcomes displayed or referenced by the Application are not indicative of, and do not guarantee, future results. Hypothetical or simulated performance has inherent limitations and does not represent actual trading.

The User assumes full, exclusive, and unconditional responsibility for every trading or investment decision made, whether or not such decision was influenced in any way by the Application. The User agrees that any gains, losses, missed opportunities, tax consequences, transaction costs, margin calls, liquidations, or other financial outcomes resulting from the User's use of the Application are the sole responsibility of the User.

The Application and all content delivered through it are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties, representations, or conditions of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, the Service Provider expressly disclaims all warranties, including but not limited to: warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, reliability, availability, uptime, security, error-free or uninterrupted operation, profitability, or suitability for any specific trading or investment objective.

No oral or written information, advice, or statement obtained by the User from the Service Provider, the Application, or any third party shall create any warranty not expressly stated in these terms.

The User is solely responsible for: (a) conducting independent research and due diligence before making any financial decision; (b) consulting with qualified, licensed, and independent financial, investment, legal, tax, and accounting professionals appropriate to the User's jurisdiction and personal circumstances; (c) evaluating the User's own financial position, risk tolerance, investment objectives, time horizon, liquidity needs, and regulatory status before entering any position; (d) complying with all laws, regulations, rules, and tax obligations applicable to the User in every jurisdiction where the User resides, operates, or trades; (e) verifying the accuracy of all data, prices, charts, and information before acting; and (f) understanding the products, markets, and strategies the User engages with.

The User should never trade or invest with funds the User cannot afford to lose. If the User does not fully understand the risks involved, the User should not trade and should seek qualified professional advice.

To the maximum extent permitted by applicable law, under no circumstances and under no legal or equitable theory—whether in contract, tort (including negligence), strict liability, statute, or otherwise—shall the Service Provider be liable to the User or to any third party for any: (a) direct losses; (b) indirect, incidental, consequential, special, exemplary, or punitive damages; (c) loss of profits, revenue, savings, business opportunity, goodwill, reputation, or anticipated gains; (d) loss of data, trading records, portfolio state, or configuration; (e) trading losses, margin losses, liquidation losses, slippage, or opportunity cost; (f) damages arising from inaccurate, delayed, incomplete, or erroneous AI output; (g) damages arising from reliance on any analysis, signal, or content generated by the Application; (h) damages arising from interruption, unavailability, bugs, or defects in the Application; or (i) damages arising from third-party services, data providers, or infrastructure relied upon by the Application.

This limitation applies even if the Service Provider has been advised of the possibility of such damages and even if a limited remedy fails of its essential purpose. The User's sole and exclusive remedy for dissatisfaction with the Application is to discontinue using it. Some jurisdictions do not allow certain exclusions or limitations; in such jurisdictions, the Service Provider's liability shall be limited to the minimum extent permitted by law.

The User agrees to indemnify, defend, and hold harmless the Service Provider, and any affiliated parties, from and against any and all claims, demands, lawsuits, actions, proceedings, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the User's use or misuse of the Application; (b) the User's trading, investment, or financial decisions; (c) the User's violation of these terms or applicable law; (d) the User's reliance on any AI-generated content; or (e) any third-party claim arising from the User's activity in connection with the Application.

Analyses produced by the Application are generated primarily from images and inputs submitted by the User. The quality, accuracy, completeness, authenticity, legibility, and interpretability of such inputs are the sole responsibility of the User. Images that are blurry, cropped, edited, manipulated, low-resolution, from unreliable sources, or from unknown assets may produce inaccurate or misleading results.

The Application may integrate or depend on third-party services, data providers, APIs, or infrastructure. The Service Provider does not control and is not responsible for the accuracy, availability, security, privacy practices, or content of any third-party service.

The Application is not a registered investment adviser, broker-dealer, exchange, alternative trading system, money service business, or financial institution in any jurisdiction. The Application has not been reviewed, approved, endorsed, certified, or licensed by any regulatory authority, including without limitation the U.S. Securities and Exchange Commission (SEC), the U.S. Commodity Futures Trading Commission (CFTC), the Financial Industry Regulatory Authority (FINRA), the Financial Conduct Authority (FCA, United Kingdom), the European Securities and Markets Authority (ESMA), the Sermaye Piyasası Kurulu (SPK, Türkiye), the Bankacılık Düzenleme ve Denetleme Kurumu (BDDK), or any comparable body.

The Application does not execute trades, custody funds, accept deposits, hold client assets, or provide any regulated financial service. All trading execution occurs solely through the User's own accounts with licensed third-party brokers or exchanges, governed by their own terms.

United States: The Application is not directed at U.S. residents for the purpose of providing investment advice. Content does not take into account the specific circumstances of any investor and is not personalized advice under the Investment Advisers Act of 1940 or equivalent state law.

European Union / United Kingdom: The Application does not provide investment advice within the meaning of MiFID II, and no content constitutes a personal recommendation under FCA rules.

The Service Provider makes no representation that the Application is suitable for professional trading, institutional use, regulated financial advice, algorithmic execution, compliance reporting, or any other specific use case. The User is solely responsible for determining whether the Application is appropriate for the User's needs.

The Service Provider may update or modify this disclaimer at any time without prior notice. Any changes will be effective immediately upon posting on this page or within the Application. The User is responsible for reviewing this disclaimer periodically. Continued use of the Application after any change constitutes the User's acceptance of the updated disclaimer.
